What is Title Insurance?
Title insurance protects you from financial loss due to past issues affecting ownership, such as liens, forged deeds, recording errors, or claims from unknown heirs It’s paid once at closing and covers you for as long as you own the property.
Who Pays for Title Insurance?
Lender’s title insurance is usually paid by the buyer as part of closing costs .
Owner’s title insurance is optional but common:
- In Miami-Dade, Broward, Sarasota, and Collier counties, the buyer typically pays and chooses the title company
- In most other Florida counties, the seller traditionally pays and chooses the title company
- This is negotiable in the purchase contract, so the terms can vary.
How Much Does It Cost?
- Premiums are generally less than 1% of the purchase price and less than 10% of total closing costs
- Paid once at closing, it provides lifelong coverage for the policyholder and heirs.
What Does a Title Company Do?
A title company:
- Conducts a title search to verify ownership and identify liens, easements, or encumbrances
- Resolves title issues before closing.
- Prepares and records deeds and closing documents.
- Holds funds in escrow until all conditions are met.
- Issues title insurance policies.
- Records the deed with the county clerk
